Vires of Notification issued under section 7 of the The Waqaf Properties Ordinance, 1979 could only be assailed by way of petition u/s. 11 before the District Court, whereas under sections 21 & 23 suit as well as other legal proceedings was specifically barred. Once established that jurisdiction of the Civil Court was ousted, then no further inquiry needed and plaint was liable to be rejected at its inception.
