Section 100 CPC. Regular Second Appeal---

Evacuee Property put to open auction by settlement authority --- Successful auction purchaser of the said property accordingly made payment of consideration--- Auction confirmed and PTO/ PTD issued in favour of the auction purchaser /respondent-plaintiff in the year 1961?held that after issuance of PTD the settlement authority became functus officio and any re-allotment of the said property by the Deputy Settlement Commissioner is declared as collusive, illegal, void, coram non-judice. Appeal of subsequent allottee stand dismissed.
