رجسٹریشن ایکٹ ، 1908-- سیکشن 32 ، 34 ، 77-- سیکشن 77 کے تحت مقدمہ کا دائرہ کار رجسٹریشن سے انکار کی قانونی حیثیت کی جانچ پڑتال تک محدود ہے نہ کہ بنیادی لین دین یا عنوان کی صداقت-- پاور آف اٹارنی کنٹریکٹ ایکٹ ، 1872 کی دفعہ 201 کے تحت پرنسپل کی موت پر ختم ہوجاتا ہے ۔ جہاں رجسٹریشن کا عمل مکمل ہونے سے پہلے پرنسپل کی موت ہو گئی تھی ، وکیل کے پاس اس کی طرف سے کارروائی کرنے کا قانونی اختیار ختم ہو گیا تھا ؛ اس کے نتیجے میں ، سب رجسٹرار کی طرف سے رجسٹریشن سے انکار کو جائز اور جائز قرار دیا گیا ۔ اپیلیٹ کورٹ کا ٹرائل کورٹ کے فیصلے کو الٹنا ثبوتوں کو غلط پڑھنے اور نہ پڑھنے پر مبنی پایا گیا-- اپیلیٹ کورٹ کے فیصلے کو کالعدم قرار دیا گیا اور دفعہ 77 کے تحت مقدمہ خارج کر دیا گیا ۔ دفعہ 77 کے تحت مقدمے کو خارج کرنا مخصوص کارکردگی کے لیے ایک آزاد مقدمے کو روکتا نہیں ہے ، کیونکہ رجسٹریشن ایکٹ اور مخصوص ریلیف ایکٹ کے تحت علاج الگ الگ شعبوں میں کام کرتے ہیں اور کارروائی کی الگ الگ وجوہات سے پیدا ہوتے ہیں ۔
