 آئین کا آرٹیکل 10-اے مجرمانہ الزامات کے ساتھ ساتھ شہری حقوق اور ذمہ داریوں کے تعین میں منصفانہ مقدمے کی سماعت اور مناسب عمل کے بنیادی حق کی ضمانت دیتا ہے ۔ آئین کے آرٹیکل 187 کے تحت ، سپریم کورٹ کو یہ اختیار حاصل ہے کہ وہ اس طرح کی ہدایات ، احکامات یا فرمان جاری کرے جو اس کے سامنے زیر التواء کسی بھی معاملے یا معاملے میں مکمل انصاف کرنے کے لیے ضروری ہو ۔ یہ آئینی اختیار پورے پاکستان میں تمام انتظامی اور عدالتی حکام بشمول ہائی کورٹس کو پابند کرتا ہے کہ وہ عدالتی عمل کو منظم کرنے کے مقصد سے قانونی مینڈیٹ کے موثر نفاذ کو یقینی بنانے کے لیے سپریم کورٹ کی ہدایات پر عمل کریں ۔

سپریم کورٹ نے ملک بھر کی تمام عدالتوں کو ہدایت جاری کی ہے کہ وہ غیر قانونی انکشاف ایکٹ کے تحت دائرہ اختیار کا استعمال کریں ، تاکہ اس بات کو یقینی بنایا جا سکے کہ وہ ایکٹ کے ذریعہ مقرر کردہ طریقہ کار کے علاوہ ، درج ذیل ہدایات پر عمل کریں:
(i) شکایت کا نوٹس لینے پر ایکٹ کے تحت شکایت کو ضبط کرنے والی ہر ٹرائل کورٹ کو ایکٹ کے سیکشن 5 (2) کے ذریعہ متعین کردہ 60 دن کے وقت کے اندر اسے مکمل کرنا چاہئے اور اس کے مطابق کارروائی کا روزانہ آرڈر شیٹ برقرار رکھنا چاہئے ۔ (ii) جہاں سماعت سماعت کے لئے مقرر کردہ تاریخ پر آگے نہیں بڑھ سکتی ہے ، ٹرائل کورٹ تاخیر کے لئے آرڈر شیٹ میں خاص طور پر کافی وجوہات درج کرے گی ۔ "گواہوں کی عدم دستیابی" یا "وکیل کی طرف سے مانگی گئی التوا" کے محض حوالہ جات سیکشن 5 (2) (iii) کے مقاصد کے لیے کافی وجوہات نہیں بنائیں گے ۔ تاہم ، کسی بھی التوا کی منظوری جائز وجہ پر مبنی ہوگی ۔ (iv) متعلقہ ہائی کورٹس/ڈائریکٹر جنرل ڈسٹرکٹ جوڈیشری کی ممبر انسپیکشن ٹیم وقتا فوقتا اپنے اپنے دائرہ اختیار میں ٹرائل کورٹس کے سامنے ایکٹ کے تحت زیر التواء تمام مقدمات کی نگرانی کرے گی ، جس میں شناخت کی جائے گی: (a) شکایت درج کرنے کی تاریخ ؛ (b) ملزم کے خلاف معاملے میں نوٹس لینے/چارج تشکیل دینے کی تاریخ ؛ (c) زیر التواء کارروائی کی حیثیت ؛ اور (d) جہاں ساٹھ دن کی مدت سے تجاوز کر چکی ہے ، اس کے لئے درج وجوہات ؛ (v) شکایت گواہوں کی فہرست کے ساتھ ہوگی اور ان کے بیانات ریکارڈ کرنے کے لئے ٹرائل کورٹ کی طرف سے مقرر کردہ ہر تاریخ پر ان کی موجودگی کو یقینی بنائے گی ۔ شکایت کنندہ اور ملزم ، جس کی نمائندگی وکیل کرے گا ، سماعت کی ہر تاریخ پر عدالت کے سامنے اپنے وکیل کی موجودگی کو یقینی بنائے گا ۔

(vi) اگر کوئی فریق ٹرائل کورٹ کے عبوری حکم کو کسی اعلی فورم کے سامنے چیلنج کرتا ہے ، تو ٹرائل کورٹ کو ٹرائل کے ساتھ آگے بڑھنا چاہیے ، جب تک کہ کسی اعلی فورم کے ذریعے روک تھام کا حکم منظور نہ کیا جائے ۔ 

Article 10-A of the Constitution guarantees the fundamental right to a fair trial and due process in the determination of criminal charges as well as civil rights and obligations. Under Article 187 of the Constitution, the Supreme Court possesses the authority to issue such directions, orders, or decrees as may be necessary for doing complete justice in any case or matter pending before it. This constitutional power obligates all executive and judicial authorities including the High Courts, throughout Pakistan to act upon the directions of the Supreme Court to ensure effective implementation of statutory mandates for the purpose of regulating judicial process.

Supreme Court issue directions to all courts across the country exercising jurisdiction under the ILLEGAL DISPOSSESSION ACT, to ensure that they adhere to the following instructions, in addition to the procedure prescribed by the Act:
(i) Every Trial Court seized of a complaint under the Act upon taking cognizance of the complaint should complete the same within 60 days time frame specified by section 5(2) of the Act and maintain a day-to-day order sheet of proceedings accordingly;
(ii) Where the trial cannot proceed on the date fixed for hearing, the Trial Court shall, specifically record sufficient reasons in the order sheet for the delay. Bare references to "non-availability of witnesses" or "adjournment sought by counsel" shall not constitute sufficient reasons for the purposes of section 5(2);
(iii) No adjournment shall be granted as a routine. However, the grant of any adjournment shall be based on justifiable reason;
(iv) Member Inspection Team of the respective High Courts/Director General District Judiciary shall periodically monitor all cases pending under the Act,before Trial Courts in their respective jurisdictions, identifying: (a) the date of filing of complaint; (b) the date of taking cognizance in the matter/framing of charge against the accused; (c) the status of pending proceedings; and
(d) where the sixty-day period has been exceeded, the reasons recorded therefor;
(v) The complaint shall accompany the list of witnesses and shall ensure their presence on each date fixed by the Trial Court for recording their statements. The complainant and the accused,represented by a counsel, shall ensure presence of their counsel before the court on every date of hearing.
(vi) In case any party challenges an interim order of the Trial Court before a higher forum, the Trial Court must proceed with the trial, unless a restraining order is passed by a higher forum.
