سیکشن 30 (1) 30 (2) اور سیکشن 36 آف کالونائزیشن آف گورنمنٹ لینڈ ایکٹ ، 1912---بورڈ آف ریونیو ، پنجاب نے 31.10.1995 کے نوٹیفکیشن کے ذریعے الاٹمنٹ یا متبادل الاٹمنٹ کے احکامات دینے کے لیے ضلع کلکٹروں کے اختیارات واپس لے لیے ۔ ؟ ؟ نوٹیفکیشن کے اوپر پوسٹ کریں ریاستی زمین کے ملکیتی حقوق دھوکہ دہی اور غلط بیانی کے ذریعے ضلع کلکٹر سے حاصل کیے گئے تھے-کالونی ایکٹ ، 1912 کی دفعہ 30 (1) کالونی کی زمین کی کمان رکھتی ہے یہاں تک کہ اگر ملکیتی حقوق دیئے گئے ہوں ، نقل و حمل کا دستاویز جاری کیا گیا ہے جو ہمیشہ اور ہمیشہ شرائط کے بیان کے تابع رہتا ہے جبکہ ایکٹ کی دفعہ 30 (2) کے تحت رکن بورڈ آف ریونیو کو اس طرح کے ملکیتی حقوق کے حصول میں کسی بھی غیر قانونی یا غلط کمیٹی یا دھوکہ دہی کو کالعدم کرنے کا دائرہ اختیار فراہم کرتا ہے ۔ ریاستی زمین کی بحالی سے متعلق ریونیو کی درجہ بندی کے حکم کے خلاف ، سول کورٹ کے پاس ایکٹ ، 1912 کی دفعہ 36 کے تحت مذکورہ قانونی فورموں کے ذاتی دائرہ اختیار میں داخل ہونے کا کوئی دائرہ اختیار نہیں ہے ۔
Section 30(1), 30(2) and Section 36 of Colonization of Government Land Act, 1912--- Board of Revenue, Punjab vide notification dated 31.10.1995 withdrew the powers of District Collectors to make any orders of allotment or alternate allotment.? Post above notification Proprietary rights of state land were obtained from District Collector through fraud and misrepresentation -- Section 30(1) of the Colony Act, 1912 holds command qua the colony land even if proprietary rights granted, conveyance deed issued that always and ever remain subject to the statement of the conditions whereas under Section 30(2) of the Act ibid confers jurisdiction to Member Board of Revenue to undo any illegality or wrong committee or fraud played in obtaining such proprietary rights? Against order of Revenue hierarchy regarding resumption of the state land, the Civil Court has no jurisdiction to enter into the vested jurisdiction of said statutory fora under Section 36 of the Act, 1912 ibid --- High Court is well within competence under section 115 CPC to reverse the concurrent illegal determinations of the lower judicial fora
