“It was also urged by the appellant in
its written arguments that respondent
No.1’s case was not pending in terms of
section 2(2) of the Repealing Act. In our
view, since respondent No.1’s claim
against the garden land was not
satisfied, it cannot be said that his case
was not pending.”
