ضلع بنوں، کے پی میں چادر یا پرچی کے نام سے مقامی رواج رائج ہے، اور جس کی بنیاد پر اس علاقے کی خواتین کو ان کی آبائی جائیداد میں وراثت کے حقوق سے محروم کیا جا رہا ہے، لہذا ہم ایسی کسی بھی رسم یا استعمال کا اعلان کرتے ہیں جو یا تو "چادر" یا "پرچی" کے نام سے یا کے پی کے ضلع بنوں کے علاقے میں یا کسی اور نام کے ساتھ موجود ہے۔ ملک کا صوبہ غیر اسلامی اور غیر قانونی ہے جس کی وجہ سے عورتوں کے وراثت کے حق کو مکمل یا جزوی طور پر ان کی آبائی جائیداد سے محروم کر دیا گیا ہے جو انہیں وراثت میں ملی ہے یا کوئی اور عمل جو خواتین کو ان کے وراثت کے حق سے محروم کرتا ہے، جو قرآن و سنت میں دیا گیا ہے، یہ غیر اسلامی ہے اور قرآن و سنت کے اصولوں کے خلاف ہے، لہذا غیر قانونی اور غیر قانونی ہے، اور سزا کے تابع بھی ہوسکتا ہے. ہم مزید اعلان کرتے ہیں کہ ایسی تمام یا کوئی بھی روایت یا استعمال، جو کسی بھی طرح سے خواتین کے وراثت کے حقوق کو متاثر کرتا ہے، چاہے وہ ملک کے کسی بھی علاقے میں کسی بھی نام سے پکارا یا جانا جاتا ہو، غیر اسلامی اور غیر قانونی ہے اور پی پی سی کی دفعہ 498-اے کے تحت اس طرح کے جرم کے مجرم کے خلاف کارروائی کا مطالبہ کرتا ہے، چونکہ ریاست کے متعلقہ حکام کی طرف سے اس طرح کے اقدامات امر بل معروف و نہیں انل منکر کے دائرہ کار میں آتے ہیں ، جو 1991 کے ایکٹ ایکس (نفاذ شریعت ایکٹ ، 1991) کے تحت ریاست کی ایک اہم ذمہ داری ہے۔
Local custom, is prevalent in District Bannu, K.P with the name of Chaddar or Parchi, and the basis of which women of that area are being deprived of their rights of inheritance in their ancestral property, hence we declare any such custom or usage which either exists with the name of “Chaddar” or “Parchi” or with any other name in the area of Bannu District of K.P or in any part of any province of the country, as non Islamic and illegal having no legal force whatsoever by virtue of which the right of inheritance of women is denied wholly or partly from their ancestral property which they have inherited or any other practice which deprives women from their right of inheritance, which is granted by the Holy Quran and Sunnah, is un-Islamic and against the principles of the Holy Quran and Sunnah, hence void and illegal, and may be subject to punishment also. We further declare that all or any such custom or usage, which affects the rights of inheritance of women in any manner whatsoever, irrespective of the name by which it is called or known in any area of the country, is un-Islamic and illegal and calls for actions against the perpetrator of such crime under Section 498-A of PPC, as such actions by the relevant authorities of the State falls within the scope of Amr bil Maroof Wa Nahi Anil Munkar, which is an important duty of the State under the Act X of 1991 (Enforcement of Shari’ah Act, 1991).
