 تنازعہ پارٹیاں عارضی بکنگ آرڈر میں شامل معاہدے کی شرائط و ضوابط کے مطابق گاڑی کی فروخت اور ڈیلیوری سے متعلق ہیں جو سول کورٹ کے دائرے میں آتا ہے اور پنجاب کنزیومر پروٹیکشن ایکٹ ، 2005 کی دفعات کے تحت نہیں آتا ہے اس وجہ سے کہ مدعا علیہ کو کوئی پروڈکٹ نہیں پہنچایا گیا تھا اور اس طرح وہ ناقص پروڈکٹ والا صارف نہیں تھا ۔

Dispute inter se the parties pertains to sale and delivery of vehicle pursuant to terms and conditions of agreement incorporated in the Provisional Booking Order which falls within the ambit of Civil Court and is not covered under the provisions of the Punjab Consumer Protection Act, 2005 for the reason that no product was delivered to the Respondent and as such, he was not a consumer with defective product.
