Under Order III, Rule 4 of the CPC read with Section 22(3) of the Legal Practitioners and Bar Councils Act, 1973, an advocate appointed through a Wakalatnama is granted the authority to represent and act for the appointing party in court. It is true that a Wakalatnama does not automatically confer an unbridled authority on a counsel to compromise or withdraw a matter without specific authorization or client instructions. However, where a solemn statement or concession is made litigant cannot by a duly engaged advocate in open court, a litigant cannot subsequently disown it as a matter of routine convenience without demonstrating concrete evidence of lack of authority or fraud.
Furthermore, the law regarding the invocation of Section 12(2), CPC res integra. It is on grounds of fraud or misrepresentation is no longer a settled principle of law, as authoritatively enunciated by this Court in Messrs Dadabhoy Cement Industries Ltd, and reiterated in Bashir Ahmad, that a mere general or bold assertion of fraud is legally insufficient. The party seeking to set aside a judicial order under Section 12(2), CPC must specifically plead and substantiate the exact misrepresentation with cogent particulars of the alleged fraud or material. Bare allegations unsupported by evidence do not warrant a full-fledged inquiry. Equally fundamental is the doctrine of equitable estoppel and the principle that a litigant who reaps the full benefit of a consent order by enjoying the grace period allowed by the Court is barred from subsequently turning around to repudiate that very consent. Permitting a party to approbate and reprobate at will would violate basic principles of equity and undermine the finality of judicial proceedings.
