 اس طرح کا معاملہ عجیب و غریب حالات پیش کرتا ہے جس میں دونوں سابق میاں بیوی اپنے دوسرے میاں بیوی کے ساتھ اپنی اپنی ازدواجی زندگی میں ڈوبے ہوئے دکھائی دیتے ہیں اور ان شادیوں سے ان کے بچے ہوتے ہیں جبکہ مادری دادی عدالت کے سامنے نابالغ کے لیے وقف ہوتی ہے ۔ بزرگ خاتون خود بھی حاضری میں موجود ہوتی ہے جو ہوشیار اور اچھی صحت میں دکھائی دیتی ہے جس سے توقع کی جاتی ہے کہ وہ نظرانداز کیے گئے بچے کی طرف سے اپنا فرض نبھائے گی ، اس کے ساتھ وقت گزارے گی اور اس کی بحالی کے جذبے کے ساتھ جوانی میں داخل ہونے کے لیے رہنمائی کرے گی جو اس وقت ظاہر ہوتا ہے کہ اس کے والد کی لاپرواہی کی افسردگی ہے جسے وہ باقاعدہ دیکھ بھال الاؤنس کی ادائیگی کے ذریعے درست کرنے کی ہر ممکن کوشش کرے گا جبکہ متعلقہ عدالت جہاں ملاقات کا معاملہ فریقین کے مطابق واضح طور پر زیر التوا ہے اس بات کو یقینی بنائے گی کہ اس حکم کی وصولی پر ایک ورکنگ وزٹیشن شیڈول کو فوری طور پر نافذ کیا جائے اور اس طرح کے ڈھانچے کے مرکز میں نابالغ کی فلاح و بہبود کو مدنظر رکھتے ہوئے اسے باضابطہ طور پر حتمی شکل دی جائے ۔

نابالغ بیٹیوں کی ماموں دادی کو تحویل میں دینا جو اپنی نشوونما کے ایسے حساس سالوں میں ہیں جب انہیں بعض حالات میں مخلص ماں کی دیکھ بھال کی ضرورت ہوتی ہے ، قانون کی پالیسی سے اجنبی نہیں ہے اور اس سلسلے میں متعدد مثالیں موجود ہیں ۔ 

The case as such presents peculiar circumstances in which both former spouses appear steeped in their respective matrimonial lives with their second spouses and have children from those matrimonies whereas the maternal grandmother is devoted to the minor before the Court. The senior lady herself is also in attendance who appears to be alert and in good health who is expected to do her duty by the neglected child, spend time with her and guide her to enter into adulthood with a repaired spirit that at the moment appears to carry the melancholy of her father’s neglect which he shall make every effort to rectify by paying regular maintenance allowance while the court concerned where the matter on visitation is statedly pending according to the parties shall ensure that a working visitation schedule is immediately enforced on receipt of this Order and is duly finalized keeping the welfare of the minor at the heart of such structure.

Entrusting custody with the maternal grandmother of minor daughters who are in such sensitive years of their development when they need the presence of sincere maternal care in certain situations is not alien to the policy of law and a number of precedents exist in this regard.
