یہ واضح قانون ہے کہ ایک شریک مالک کو مشترکہ ہولڈنگ کے ہر انچ پر تعمیری قبضہ سمجھا جاتا ہے جب تک کہ باضابطہ تقسیم نہ کی گئی ہو۔ شریک ملکیت کے بارے میں فقہ مستقل طور پر اس بات کی تصدیق کرتی ہے کہ ایک شریک مالک تقسیم کی کارروائی کے ذریعے خصوصی قبضہ قائم کیے بغیر دوسرے کے ہاتھوں قبضے کا الزام نہیں لگا سکتا۔

  It is trite law that a co-owner is deemed to be in constructive possession of every inch of the joint holding unless a formal partition has been effected. The jurisprudence on co-ownership consistently affirms that one co-owner cannot allege dispossession at the hands of another without establishing exclusive possession through partition proceedings.
